Commercial Leases and Disrepair:
Landlords' remedies during the term - the state of the law

Speaker: Warren Potts

Venue: Chambers

This seminar will look at the present state of the law concerning landlords' remedies for disrepair of commercial premises during the term. In a recession, each remedy has its own particular drawbacks. Twenty years ago the law relating to forfeiture was said to be in need or urgent reform yet it remains a minefield. Commercial landlords now face new difficulties following the decision of the Court of Appeal in Agricullo v Yorkshire Housing, widely regarded as an unsatisfactory and harsh ruling.
This seminar compares the various alternative remedies available and examines each one from the practitioner's point of view. It considers practice and procedural points ready to trap the unwary and focuses on the present attitude of the courts in the light of Agricullo and asks the key question whether it is now better to advise commercial landlords to litigate rather than negotiate.

Cost £23.50 (inclusive of vat)
Registration will be at 5.00pm with the seminar commencing at 5.30pm for 1 Hour.

CPD Points available: 1
