Brad Pomfret

 

Brad specialises in chancery and commercial. His practice includes the following areas: contractual disputes, professional negligence, trusts, contentious probate, duties of executors and trustees, real property, soft intellectual property, company and partnership, consumer credit, restraint of trade and civil actions for fraud.

A significant part of Brad's practice is insolvency, both personal and corporate. He acts for insolvency practitioners, debtors and creditors. He frequently appears in the applications lists and has experience of a wide range of insolvency matters, including disputed winding-up petitions, setting aside transactions, the phoenix provisions and office holders' liability. Sale of goods and consumer law is a particular area of interest for Brad. He acts for multi-national retailers and small businesses, as well as consumers. He is the author of "Where did I put that receipt?" SJ (2003) Vol 147 No.32, 951-952. He offers seminars on retention of title clauses, remedies in sale of goods disputes and other commercial areas. Brad frequently appears in the Chancery Division of the High Court and has experience of being led by Silk. He has also appeared in the TCC, the Queen's Bench Division, the Magistrates and various other courts. He has appeared in the Court of Appeal, including in the notable case of Ennis v Thewlis (2005) EWCA Civ 471; a civil action for fraud involving third party assistance in the breach of a fiduciary's duty.

Spare time interests include holding a season ticket at Manchester City, playing golf as a member at Chorlton-cum-Hardy golf club and music.
